
PPSV Principal Rob Lavet, formerly General Counsel of Sallie Mae, presented a webinar for APSCU on the US Supreme Court opinion in AT&T Mobility LLC v. Concepcion, which holds that the Federal Arbitration Act preempts state laws that invalidate class action waivers in consumer arbitration agreements. Rob discussed the implications of this decision for schools and how schools can draft and enforce effective arbitration clauses to be included in enrollment agreements as well as institutional loans or payment plans. The presentation also discussed the possible impact of the new Consumer Financial Protection Bureau in the area of consumer arbitration.
