Judith A. Buckalew, Director of Public Policy and Legislation at Powers Pyles Sutter & Verville PC, has secured $2.5 million in funding from the Department of Defense for the Yale New Haven Health System Center for Emergency Preparedness to establish the National Center for Integrated Civilian-Military Domestic Disaster Medical Response. The Yale New Haven Health System is the only hospital system in the United States to be recognized by the Centers for Disease Control as a Center for Emergency Preparedness, a designation obtained with the assistance of Ms. Buckalew.

His federal regulatory and legislative practice will also focus in the areas of rehabilitation, employment, education, social security, and civil rights. Mr. Silverstein is currently the director of the Center for the Study and Advancement of Disability Policy (www.disabilitypolicycenter.org). The Center conducts research and analysis of complex public policy issues affecting individuals with disabilities and their families. Prior to directing the Center, Mr. Silverstein was Staff Director and Chief Counsel for the US Senate Subcommittee on Disability Policy chaired by Senator Tom Harkin.

Mr. Portman concentrates his practice on counseling nonprofit organizations in healthcare, education, business, social services, and numerous other fields. He represents national and state professional societies, trade associations, certification bodies, and voluntary health and social service organizations. He counsels these clients on a wide range of legal issues, including governance, antitrust, transactions, tax exemption issues, intellectual property, election and lobbying law, and legislation and regulation in healthcare and other fields. Mr. Portman also represents numerous individual physicians, medical groups, other health care providers, and manufacturers and distributors of various health care products. Mr. Portman augments the firm’s significant depth of experience in HIPAA patient privacy rules; Stark II self-referral and Medicare-Medicaid anti-kickback counseling; physician-hospital transactions and medical staff issues; antitrust, EMTALA, and FDA counseling; and numerous other health law issues.

PPSV Represents 28 State and National Mental Health Organizations in Important Medical Privacy Case

Founding partner James C. Pyles filed an amicus curiae brief on behalf of the 28 state and national mental health practitioner and patient organizations in a case pending before the Maryland Court of Special Appeals entitled Maryland State Board of Physicians v. Harold I. Eist, M.D., Case No. 00329. The amicus brief supports a prominent psychiatrist who delayed in turning over the psychiatric records of a mother and her two minor children to the Maryland Board of Physicians. The patients strongly objected to the disclosure because the subpoena was issued in response to a complaint filed by the estranged husband who was involved in a bitter divorce and child custody proceeding with the mother. The complaint against the psychiatrist was found to be without merit, but the Board still sought to sanction and fine the psychiatrist because he complied with the wishes of his patients and adhered to his standards of professional ethics. The Circuit Court has twice overturned the Board’s sanction of the physician, and the state now seeks to have the Circuit Court decisions reversed. The 28 associations represented in the amicus curiae brief support the affirmance of the Circuit Court decisions because it is consistent with the patients' constitutionally protected rights to privacy and established standards of medical ethics.

It is a great tribute to the hard work he has put into this bar over the last several years as a Director, and for many years before that as a speaker, author and Chair of the Association's program on long term care law. It also continues the long history of contributions that people in the Firm have made to the AHLA, starting with Galen Powers, who was a founding Director of the predecessor National Health Lawyers Association and one of its early Presidents.
