PPSV represents diagnostic imaging centers, ambulatory surgery centers, clinics, radiation oncology centers, durable medical equipment suppliers, clinical laboratories, and other ambulatory care providers with respect to a broad range of legal issues.  For example, the firm:

  • Assists ambulatory care providers in achieving and maintaining state licensure, Medicare certification, and private accreditation, providing advice regarding both initial inspection and ongoing reporting requirements;
  • Structures ambulatory care providers’ relationships with referral sources in a manner that complies with applicable federal and state self-referral and fraud and abuse laws;  
  • Provides advice on compliance with state corporate practice, fee-splitting and other state restrictions on operations; 
  • Defends providers in actions involving the imposition of sanctions by federal and state authorities for alleged violation of various civil and criminal laws;
  • Organizes diagnostic and other facilities in a manner that optimizes payment from governmental and private payers, within the constraints imposed by applicable law; 
  • Drafts organizational documents in a manner intended to assure smooth governance and working relationships among facility owners; and
  • Provides guidance regarding the potential impact of future legislative and regulatory developments on facility operations and financial viability.
